ISLAMABAD (Web Desk) - Amid strong criticism from opposition parties over the issuance of the Elections (Amendment) Ordinance 2021 for open voting in the upcoming Senate elections, Dr. Babar Awan, Advisor to the Prime Minister on Parliamentary Affairs  If not supported, the ordinance will expire immediately. According to a report by a private news agency, a colleague of the prime minister told Dawn that the government has introduced the presidential ordinance with sunset clause which will expire itself if the presidential reference.  The decision of the Supreme Court comes against the open ballot and before the Senate elections. It should be noted that on December 23, 2020, President Arif Ali had approved the proposal of the Prime Minister to seek the opinion of the Supreme Court on holding the Senate elections through open ballot.  However, the government issued an ordinance to hold the Senate elections by open vote on Saturday before the Supreme Court's decision on the issue. Opposition groups called on the government to issue a "controversial" ordinance just two days after the Senate and National Assembly adjourned.  Introducing a constitutional crisis to the country  In this regard, when asked why the ordinance was issued in a hurry, Babar Awan said that the government wanted to introduce it before Thursday (February 11) because when the Election Commission of Pakistan (EC)  P) is expected to announce the schedule of Senate elections and once the schedule is announced, the Election Act 2017 cannot be amended. He objected that the government has stopped the trend of horse trading and use of money in Senate elections.  With the clear intention of doing so, the Constitutional Amendment Bill was introduced on Wednesday but the opposition spoiled the meeting by bullying. He also said that the meeting of the Senate and the National Assembly lasted for 3 weeks but the opposition did not vote in the Senate.  He did not say anything to justify his position against it. The parliamentary affairs adviser said that under the Charter of Democracy signed in 2006 between the main opposition parties PML-N and Pakistan Peoples Party (PPP), it was in Parliament.  Horse trading was agreed to stop but when the government tried to end horse trading  Asked why President Arif Ali had issued the ordinance, the adviser said that the President had not violated any constitutional principles by issuing the ordinance as under Article 50 of the Constitution.  The President is part of the Parliament. This article states that "there will be a Majlis-e-Shura (Parliament) of Pakistan consisting of the President and two Houses which will be known as the National Assembly and the Senate respectively".  Sources said that the suggestion for issuing the ordinance was put forward by Attorney General Khalid Javed Khan and was endorsed by Prime Minister Imran Khan. Not only that, but Law Minister Forough Naseem also supported the idea.  He further said that none of the leaders of Pakistan Tehreek-e-Insaf (PTI) had opposed the idea. Interestingly, the opinion of the Supreme Court under Article 186 of the Constitution was also suggested by the Attorney General.  Besides, the Election Commission has so far remained completely silent on the government's move to amend the Election Act.  Abat will be held as half of the 104 senators are retiring on March 11.
